If an amicable resolution cannot be reached, the matter shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration proceedings will be held in Fort Lauderdale, FL, and conducted in English. Each party will bear their own costs and attorney’s fees unless otherwise required by the applicable arbitration rules.

Jurisdiction: Notwithstanding the above, any disputes arising out of or relating to these Terms of Use or the services provided shall fall under the exclusive jurisdiction of the courts of Fort Lauderdale, FL, USA. You expressly agree to submit to the personal jurisdiction of these courts.

6. Limitations of Liability

Shine Beyond Limits is not liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, our materials and services. You specifically acknowledge and agree that Shine Beyond Limits is not liable for any defamatory, offensive, or illegal conduct of any user.

8. Indemnification

10. Refund Policy

All Sales Are Final: All sales of courses and digital content are final. Please carefully review course descriptions before purchase.

Case-by-Case Review: If you believe your circumstances warrant a refund, contact our support team via email at support@enjoyseamoss.com. Include your full name, purchase details, and reason for the request. Our team will review the case carefully and provide a decision within 14 business days. Refunds are processed to the original payment method within 10-15 business days.

Note: Refunds may only be provided for courses not substantially accessed or completed.

11. Effective Date

This Terms of Use Agreement is effective as of May 8, 2024. Shine Beyond Limits reserves the right to update the terms at any time. Your continued use of the service after such changes will constitute your consent to such changes.
